JustPlaneHosting (“JPH,” “we,” “us,” or “our”) is a service of Climb and Maintain, SPC, a Washington social purpose corporation.
These Terms of Service (“Terms”) govern your purchase and use of hosting, website, virtual-airline hosting, managed services, and related services from JustPlaneHosting.
By ordering, accessing, or continuing to use a JPH service, you agree to these Terms, our Acceptable Use Policy, and our Privacy Policy.
1. Eligibility and Accounts
You must be at least 18 years old, or otherwise legally able to enter into a binding contract, to purchase JPH services.
You are responsible for:
- Providing accurate account and contact information.
- Keeping your login credentials secure.
- Maintaining access to the email address associated with your account.
- Activity performed through your account by people you authorize to use it.
Please contact us promptly if you believe your account has been compromised.
2. Services
The exact features, limits, management level, storage, bandwidth, software, and other resources included with your service are described on the applicable order or product page.
Different JPH plans include different amounts of assistance.
A service described as managed includes only the management tasks identified for that plan. Managed hosting does not automatically include unlimited development, custom programming, content creation, graphic design, third-party software support, or work unrelated to normal operation of the hosted service.
Services that are not described as managed remain primarily under the customer's control and responsibility.
We may make reasonable technical changes to our hosting environment when necessary for security, reliability, compatibility, upstream-provider requirements, or continued operation of the service.
3. Third-Party Infrastructure and Software
JPH relies on third-party infrastructure, networks, software, payment processors, domain services, and other service providers.
Your use of JPH services must therefore also comply with any restrictions imposed on us by our infrastructure or service providers.
We may need to modify, restrict, suspend, or discontinue a particular feature when required by an upstream provider or when continuing to offer that feature would create a security, legal, or operational problem.
Third-party applications such as content-management systems, virtual-airline software, plugins, themes, and other customer-installed or customer-selected software may have their own licenses and terms.
Unless a JPH service specifically says otherwise, JPH does not warrant the availability, security, compatibility, or continued development of third-party software.
4. Billing and Automatic Renewal
Hosting services are billed according to the billing period selected when you order.
The price and billing frequency are displayed before purchase.
You may cancel recurring service at any time before the next renewal to prevent future charges.
We will not intentionally use hidden enrollment, pre-checked subscription options, or deliberately obscure cancellation procedures.
Taxes, where required, may be added to the listed price.
5. Cancellation
You may request cancellation through the customer portal or by contacting JPH support.
Unless you request immediate cancellation, service will ordinarily remain active through the end of the period already paid for.
Cancellation stops future renewal. It does not necessarily delete your account immediately.
If you request immediate cancellation, hosted data may become inaccessible or be deleted immediately.
6. Refunds
New Hosting Accounts
New hosting customers may request a refund of hosting fees within 30 days of the initial purchase.
This guarantee applies to the first purchase of an eligible hosting service and does not restart when the customer changes plans, cancels and reorders, or creates another account.
Renewal Charges
If a hosting service renews and you did not intend to continue it, contact us within 7 days of the renewal charge.
We will generally refund that renewal and terminate the renewed service, provided that the account has not incurred significant resource costs, overages, abuse-related costs, or other unusual expenses during the renewed period.
Nonrefundable Items
Unless otherwise required by law, the following are not refundable:
- Domain registration, transfer, or renewal fees.
- Third-party licenses or services purchased specifically for the customer.
- One-time work that has already been substantially completed.
- Usage charges, overages, or similar consumed resources.
- Fees arising from abuse, chargebacks, or violations of these Terms.
If a third-party charge can be reversed without cost to JPH, we may choose to refund it even when these Terms do not require us to.
Nothing in this section limits refund or cancellation rights that cannot legally be waived.
7. Late or Failed Payments
If payment fails or an invoice remains unpaid, we may suspend affected services.
We will normally attempt to give the customer an opportunity to correct an ordinary billing problem before deleting hosted data.
Persistent nonpayment may result in termination and deletion of the account.
We are not required to preserve data indefinitely after suspension, cancellation, or termination.
8. Chargebacks and Payment Disputes
Please contact us before filing a chargeback if you believe a payment is wrong.
We are happy to investigate billing mistakes.
A chargeback or payment reversal may cause the affected service to be suspended while the dispute is investigated.
Fraudulent chargebacks or deliberate abuse of the payment-dispute process may result in account termination.
9. Customer Content
You retain ownership of content that you upload or create.
You grant JPH the limited rights necessary to store, transmit, copy, back up, restore, and otherwise process that content solely as needed to provide the service.
You are responsible for ensuring that you have the legal right to store and publish your content.
JPH does not claim ownership of customer websites, databases, virtual-airline data, documents, graphics, or other customer-created material.
10. Backups
JPH or its infrastructure providers may create automated backups or recovery copies of hosted accounts.
Unless a specific JPH plan expressly guarantees a particular backup service, these backups are provided as a convenience and disaster-recovery measure, not as the customer's only backup.
Backups may:
- Fail.
- Be incomplete.
- Exclude certain files or directories.
- Be unavailable for a particular date.
- Be removed according to retention schedules.
- Be affected by account corruption, compromise, suspension, or termination.
11. Security
JPH takes reasonable measures to protect its systems and customer accounts, but no internet-connected system is perfectly secure.
Customers are responsible for:
- Using strong, unique passwords.
- Using multifactor authentication where available.
- Keeping customer-managed applications, plugins, themes, and scripts reasonably current.
- Removing unused or abandoned software.
- Securing credentials provided to staff, contractors, or other users.
- Reporting suspected compromise promptly.
Where JPH manages software under a managed-service plan, responsibility for the tasks specifically assigned to JPH shifts accordingly.
12. Resource Usage
Hosting accounts must remain within the resources and technical limits assigned to their plan and the reasonable limits of a shared hosting environment.
Occasional usage spikes are normal.
Activity that persistently consumes disproportionate CPU, memory, storage, database, email, bandwidth, or other shared resources may require optimization, restriction, or movement to a more appropriate plan.
Whenever practical, we will work with the customer before taking disruptive action.
Immediate restriction or suspension may be necessary when activity threatens server stability, security, or other customers.
13. Availability and Maintenance
We work to keep services available, but JPH does not provide a guaranteed uptime Service Level Agreement unless one is expressly included with the purchased service.
Service may occasionally be unavailable because of:
- Maintenance.
- Hardware or software failure.
- Network problems.
- Security incidents.
- DDoS attacks.
- Third-party or upstream-provider outages.
- Emergency security work.
- Events outside our reasonable control.
Planned maintenance will be communicated when practical.
14. Support
Support is provided through the support methods JPH makes available.
Response and resolution times are not guaranteed unless a specific service states otherwise.
Support does not include work outside the scope of the purchased plan unless JPH agrees to perform it.
15. Acceptable Use
You must comply with the current JPH Acceptable Use Policy.
Serious abuse may result in immediate restriction, suspension, or termination when necessary to protect users, infrastructure, third parties, or JPH.
For less urgent problems, we generally prefer to contact the customer and provide a reasonable opportunity to correct the issue.
16. Copyright Complaints
JPH respects intellectual-property rights and maintains procedures for addressing properly submitted copyright complaints.
Repeated copyright infringement may result in termination of service.

17. Suspension and Termination
We may suspend or terminate service when reasonably necessary because of:
- Material violation of these Terms or the AUP.
- Illegal activity.
- Security threats.
- Serious or repeated abuse.
- Nonpayment.
- Fraud.
- Upstream-provider requirements.
- Court orders or other lawful process.
- Activity that threatens our systems or other users.
When the situation allows, we prefer correction over surprise deletion.
Some situations, particularly phishing, malware, attacks, child sexual abuse material, active compromise, or imminent harm to infrastructure, may require immediate action.
18. Discontinuation of a Service
We may stop offering a product or service.
If we discontinue an active paid service for reasons unrelated to customer misconduct, we will make reasonable efforts to provide advance notice and, where practical, assistance moving the customer or a refund or credit for unused prepaid service.
19. Disclaimer of Warranties
To the fullest extent permitted by law, JPH services are provided “as is” and “as available.”
We do not warrant that services will be uninterrupted, error-free, immune from attack, compatible with every application, or capable of recovering every lost file.
Nothing in these Terms excludes warranties or consumer rights that applicable law does not permit us to exclude.
20. Limitation of Liability
To the fullest extent permitted by law, Climb and Maintain, SPC and JustPlaneHosting will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from JPH services, including lost profits, lost business, or lost data.
Our aggregate liability relating to a JPH service will not exceed the amount you paid JPH for the affected service during the three months immediately preceding the event giving rise to the claim, except where applicable law requires otherwise.
This limitation does not apply where liability legally cannot be limited.
21. Indemnification
You agree to defend and indemnify Climb and Maintain, SPC against third-party claims arising from content or activity under your account when the claim results from your unlawful conduct, infringement of another person's rights, or material violation of these Terms.
This provision does not require you to indemnify JPH for JPH's own unlawful conduct or negligence where applicable law prohibits doing so.
22. Changes to These Terms
We may update these Terms as JPH changes.
Material changes will be posted with a new effective date and, when appropriate, communicated to existing customers.
Changes will not retroactively alter a completed transaction merely because doing so would be convenient for us.
23. Governing Law
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles.
Unless applicable law requires otherwise, legal proceedings concerning these Terms may be brought in the state or federal courts serving Spokane County, Washington.
Nothing in this section prevents either party from bringing an eligible matter in small-claims court.
24. Entire Agreement
These Terms, the Acceptable Use Policy, the Privacy Policy, the applicable order, and any plan-specific terms form the agreement governing the service.
If a plan-specific written term conflicts with these general Terms, the more specific term controls for that service.
